Total Loss Vehicle Settlement - What Happens When Your Car Is Totaled

In our last post I explained how your insurance company would likely determine if your vehicle was a total loss from a covered accident. Understanding how your company makes this determination is important, however, understanding how they will value your car is even more important.
Once your car is determined to be a complete loss, the process that follows can be confusing. I wanted to provide some insight, from an insurer's perspective, that can help you get through the total loss process should you ever find yourself in that situation.
It is important to remember that, if your car is deemed a total loss, your carrier has a duty and obligation to pay you the ACV (Actual Cash Value) or fair market value for your vehicle. Understanding that, we want to be sure you are armed with solid & reliable information in the unfortunate event you find yourself in this situation.
The Value or ACV process:
The ACV or Actual Cash Value of your vehicle is a term that is meant to demonstrate & prove what the fair market value of your vehicle is on the date of the accident. Your carrier will have your car inspected, noting all options & features as well as estimating the condition of the vehicle prior to the accident. Below is a short list of some of the main variables involved when determining the value of your car:
  • Year, make & model
  • Features or upgrades on the car from the manufacturer
  • Is there aftermarket equipment on the car & if there is, does it add or detract from the market value
  • Condition rating: estimate of the condition of the vehicle prior to the accident
  • Mileage (this, as we all know, can have a substantial impact on value)
Your insurance carrier will then use a 3rd party, such as CCC, to secure a fair market value for your car. Here is a short list of things that a 3rd party will look at when estimating the value:
  • All of the vehicle details noted above
  • Your zip code, which tells them exactly where you live
  • Comps: most insurance companies will require at least 2 solid comparative vehicles
Note that where you live is important as vehicles can have different values based on where you live as the market (where you are) is what dictates what cars like yours would sell for at the time of the accident. Also note that the comps are how a price or value is determined as it is meant to convey what a vehicle like yours, same make/model/year, condition and features, would be worth in it's pre-accident condition.
One question or issue that does come up at times is "there aren't any vehicles exactly like mine where I live, now what?" In this scenario, most of the time the insurance company will then look for a vehicle that is a year newer than yours with similar features & in similar condition. It is usually not permitted to use an older vehicle as a comp in this case.
What if I don't agree with the value?
This is most often one of the biggest challenges when trying to settle a total loss claim: I don't agree with the valuation that my adjuster provided to me. It is ok, though, this happens frequently and if armed with good, accurate information, you can navigate your way through this. Here is how:
  • Request a copy of the valuation
  • Review the details and ensure it represents your vehicle: options, mileage, condition, etc.
  • If you feel the value is truly not accurate, do some research and find a few comps of your own, ensure they are accurate. Provide your supporting information to your carrier for consideration
  • If they don't move, advise you are formally disputing the valuation.
  • Request that your insurance company issues payment for the "undisputed amount"
  • Secure your own independent valuation, your insurance company will get one of their own
  • The two of you will then come together and compare the valuations and reach a resolution
I know, you now have a few more questions, thought you might. Let's address those:
  1. What do you mean by "undisputed amount?" You don't want your claim halted and, if you have rental coverage and are in a rental car, most insurance companies will only extend rental for a few days after they have made an offer to you to settle your total loss. The undisputed amount example: Valuation comes in at $20,000 but feel your car has a market value of $24,000 but are not disputing it is worth at least the $20,000. So, you accept the $20,000 but continue with the process. This will not prevent you from collecting more money should it be supported but it does get you something right now.
  2. If you dispute the value and go down that path, you will have to, at your own cost, have an independent market valuation completed on your car. There are some great companies out there to help you, such as http://www.iada.org/.
I highly recommend that you work directly with your insurance company directly to resolve a dispute like this. Remember, this is a negotiation based on some subjective supporting evidence and some objective information as well, such as the make, model, year and features. The insurance carriers want to settle your claim and will, most of the time, be reasonable and work with you to settle your claim.
In addition, I strongly suggest you review your policy before going down the dispute path so you understand exactly what your policy states as it relates to this type of claim. All policies and companies have differences, some subtle and some not. Your policy will be the guiding rule over your claim so it is important to understand what it says and what your rights are.
You can also refer to your state's Department of Insurance site to see if your state has specific rules and laws as it relates to the handling of a first party total loss claim.
So, in summary, hopefully now you have a better understanding of how a value is obtained, you also have an idea on what you can do if you happen to disagree with the value. Just remember to be sure you are able to support your dispute in value with solid information if you want your company to consider your position. And, recall, this IS a negotiation so be calm and deliberate with your argument and information. I can almost guarantee it will lead to a fair resolution of your total loss claim.

Total Loss Vehicle Settlement - What Happens When Your Car Is Totaled

In our last post I explained how your insurance company would likely determine if your vehicle was a total loss from a covered accident. Understanding how your company makes this determination is important, however, understanding how they will value your car is even more important.
Once your car is determined to be a complete loss, the process that follows can be confusing. I wanted to provide some insight, from an insurer's perspective, that can help you get through the total loss process should you ever find yourself in that situation.
It is important to remember that, if your car is deemed a total loss, your carrier has a duty and obligation to pay you the ACV (Actual Cash Value) or fair market value for your vehicle. Understanding that, we want to be sure you are armed with solid & reliable information in the unfortunate event you find yourself in this situation.
The Value or ACV process:
The ACV or Actual Cash Value of your vehicle is a term that is meant to demonstrate & prove what the fair market value of your vehicle is on the date of the accident. Your carrier will have your car inspected, noting all options & features as well as estimating the condition of the vehicle prior to the accident. Below is a short list of some of the main variables involved when determining the value of your car:
  • Year, make & model
  • Features or upgrades on the car from the manufacturer
  • Is there aftermarket equipment on the car & if there is, does it add or detract from the market value
  • Condition rating: estimate of the condition of the vehicle prior to the accident
  • Mileage (this, as we all know, can have a substantial impact on value)
Your insurance carrier will then use a 3rd party, such as CCC, to secure a fair market value for your car. Here is a short list of things that a 3rd party will look at when estimating the value:
  • All of the vehicle details noted above
  • Your zip code, which tells them exactly where you live
  • Comps: most insurance companies will require at least 2 solid comparative vehicles
Note that where you live is important as vehicles can have different values based on where you live as the market (where you are) is what dictates what cars like yours would sell for at the time of the accident. Also note that the comps are how a price or value is determined as it is meant to convey what a vehicle like yours, same make/model/year, condition and features, would be worth in it's pre-accident condition.
One question or issue that does come up at times is "there aren't any vehicles exactly like mine where I live, now what?" In this scenario, most of the time the insurance company will then look for a vehicle that is a year newer than yours with similar features & in similar condition. It is usually not permitted to use an older vehicle as a comp in this case.
What if I don't agree with the value?
This is most often one of the biggest challenges when trying to settle a total loss claim: I don't agree with the valuation that my adjuster provided to me. It is ok, though, this happens frequently and if armed with good, accurate information, you can navigate your way through this. Here is how:
  • Request a copy of the valuation
  • Review the details and ensure it represents your vehicle: options, mileage, condition, etc.
  • If you feel the value is truly not accurate, do some research and find a few comps of your own, ensure they are accurate. Provide your supporting information to your carrier for consideration
  • If they don't move, advise you are formally disputing the valuation.
  • Request that your insurance company issues payment for the "undisputed amount"
  • Secure your own independent valuation, your insurance company will get one of their own
  • The two of you will then come together and compare the valuations and reach a resolution
I know, you now have a few more questions, thought you might. Let's address those:
  1. What do you mean by "undisputed amount?" You don't want your claim halted and, if you have rental coverage and are in a rental car, most insurance companies will only extend rental for a few days after they have made an offer to you to settle your total loss. The undisputed amount example: Valuation comes in at $20,000 but feel your car has a market value of $24,000 but are not disputing it is worth at least the $20,000. So, you accept the $20,000 but continue with the process. This will not prevent you from collecting more money should it be supported but it does get you something right now.
  2. If you dispute the value and go down that path, you will have to, at your own cost, have an independent market valuation completed on your car. There are some great companies out there to help you, such as http://www.iada.org/.
I highly recommend that you work directly with your insurance company directly to resolve a dispute like this. Remember, this is a negotiation based on some subjective supporting evidence and some objective information as well, such as the make, model, year and features. The insurance carriers want to settle your claim and will, most of the time, be reasonable and work with you to settle your claim.
In addition, I strongly suggest you review your policy before going down the dispute path so you understand exactly what your policy states as it relates to this type of claim. All policies and companies have differences, some subtle and some not. Your policy will be the guiding rule over your claim so it is important to understand what it says and what your rights are.
You can also refer to your state's Department of Insurance site to see if your state has specific rules and laws as it relates to the handling of a first party total loss claim.
So, in summary, hopefully now you have a better understanding of how a value is obtained, you also have an idea on what you can do if you happen to disagree with the value. Just remember to be sure you are able to support your dispute in value with solid information if you want your company to consider your position. And, recall, this IS a negotiation so be calm and deliberate with your argument and information. I can almost guarantee it will lead to a fair resolution of your total loss claim.

Well unless you have been orbiting the Earth since 2004, it's highly likely that you have seen the financial health warning that all those involved in property loans are legally obliged to include in any connected financial promotion.
You may well think that this warning and its connotations were obvious, and just common sense (which is incredibly uncommon!), however you would apparently be wrong. The government watchdog, the FSA has tasked itself with increasing financial awareness of mortgage default.
However, notwithstanding the F.S.A s best efforts, the stats make poor reading; informing us that only 18- 20% of mortgage payers had any kind of Mortgage Payment Protection Insurance in place to make the mortgage payment; if they are unable to. Poor result indeed.
Question is, are the stats wrong or do the other have 80% of mortgage payers have at least three to six months net mortgage payments set aside for a rainy day?
Well, based on the level of unsecured debt spread amongst the subject group; doubtful to say the least.
Now "an Englishman's home is his castle", or so the saying goes; and to some extent this is true.
Unlike our mainland European neighbours, where renting is the popular option until the early to late forties, in Britain, we love nothing more than to saddle ourselves, as early as possible with a nice big mortgage, and the responsibility that that entails.
Unfortunately, due to the now defunct Mortgage market, based more on loan to value, than affordability, the so called "non status" and other forms of very cheap easy credit; many now have a slightly larger "castle" than they would have, if the cost and availability of credit had been more realistic.
Now the party is over, and the days of cheap self cert, and other non status lending are well and truly over, many are left with large mortgages, with no where to go and find cheaper loan; they are at the mercy of the lenders generously (or not), and the standard variable rate for the product. Many of these loans were sold on to investors, and had clauses in the contract that allowed the purchasing company to vary the charge rate in some way. Nice.
This means that many borrowers are prioritising how they use their disposable income very carefully, and one of the first cut backs is insurance, particularly MPPI.
High risk strategy to say the least, when many borrowers are desperate to secure a new re-mortgage product, perhaps saving £ 150 per month, what would they do if they could not pay 3/4 of their loan ( that not covered by any potential benefits), due to Accident Sickness or Unemployment?
Well, the 20% of borrowers that have managed to see the wood for the trees, and have prioritised income away, from say, buying your daily sandwich at Prets, into a Mortgage Payment Protection Insurance Policy, just might hold on to their home, if the event of losing their income, due to Accident, Sickness or Unemployment.
If you are one of the 20% of borrowers, who have one of these MPPI policies, that have just been made redundant, you will know that you all you need to do is register for Job Seekers Allowance at the employment centre, send off the form that they issue you with, together with the claims documentation to your insurer.
You will probably also know that once your claim is accepted, the Mortgage Unemployment Insurance Policy; will start to pay a monthly benefit to cover your mortgage, for up to 12 months or until you find a job; whichever is the sooner.
Those of you that do not have a Mortgage Payment Protection Insurance Policy, and have been made redundant, may have to face the prospect of being repossessed. A very sobering thought.
If you do not have an MPPI policy, have no impending redundancy that you know of; maybe it's time to re-prioritise your insurance imperatives and take out a Mortgage Payment Protection Policy; before it's too late.

But like dieting resolutions, scaling back a hair will help you successfully meet them. So, let's put our writing resolutions on a diet, so that we can put our power behind making our dreams come true, and focus on the crux of the issue.
Number One: Slow Down. Everyone wants to be published yesterday. That in itself isn't a bad thing-it's one of those goals that keep you slogging through the slough of despond, as John Bunyan would say. But I can promise you this is one of those instances where the tortoise beats the hare. The number-one thing I see that trips writers up is rushing. I always cringe when someone comes back to me with revisions quickly-because I know before seeing them that everything will have to be redone! Hurrying will leave cracks in the walls of your story's structure someone will drive a Mack truth through. And it's a true creativity killer.
Number Two: Take a Publishing-News Fast. Let's face it-the news from publishing is mostly depressing. Major imprints closing down. Editors losing jobs all over the place. The latest news of print sales falling 9 percent last year makes your heart plummet, even though this slack and more has been taken up with e-book sales. Some of us have no choice but to follow the business end of things, but you don't-you can take a nice long fast from this and let your creativity soar. Whenever I'm writing, I let publishing go take a long hike-in the opposite direction from the path I walk.
Number Three: Let your Creativity Soar! Write, write, write, and write. Don't self-edit as you go, just tag along behind your characters and see where they take you. Follow every thread, no matter how whimsical it seems. In fact, the more fantastical in the creative phase, the better! Run with it. Laugh, play, dance with the drama. You will go into book editing and revision way on down the line (so you never have to worry that you'll be embarrassed later about some bone-head move now). For now, be free!
Number Four: Damn the Naysayers. And those are legion! Let their lists of all the ways you can't make it in publishing roll off your shoulders. Easier said than done? Nah. Just let them ramble on and as they're doing so, say (silently), whether to your own demons or those of your mother-in-law: "You're probably right. But at this minute, I'm immersed in novel development; I have a scene, chapter, story to write. I'll get with you later."
Number Five: Remember that Writing Well is a Journey. This is not a sprint, it's a marathon. Our point isn't to be published next week. Our point is to write beautiful stories with characters who leap off the page, and with whom we all want to tag along for their journeys. All we're looking for is progress, growth, the ability to see that what you've written today was better than yesterday, or last week, or last year... And I can absolutely guarantee that if you write, if you read and study your craft, and write again, you will get better.

1. Use humor to relax and warm up your audience
The opening of your speech must grab the attention of your audience immediately. It must increase the interest of your audience and lead right into your topic. One way to begin is with a humorous story. There is a catch to this...the humorous bit must fit in with your topic. It can't be way out in left field completely cut off from the rest of your speech.
A story is more than a joke. It is longer than a joke and it has to have some background. It needs a punch line which will sashay right into your speech, but be sure to pause and wait for the laugh.
2. Know your audience
You should know several things about your audience:
- the age range - if you are speaking to an audience of older members, they will have different experiences than college students and will find different things amusing.
- the male and female ratio - gym locker room humor might be fine for a male audience, but might not go over so well to an audience of women or even a mixed group of men and women.
- an audience of a particular occupational group - you may be speaking to a group of lawyers, doctors, nurses, accountants or sales people. You could use a story or an anecdote having to do with this special group.
- a political group - if you speak to a political group, tread lightly. If your anecdote or story is offensive to someone or if the topic is controversial to someone, you will usually lose the attention of these listeners
the education level of your audience - their education level will affect the kind of story you tell, the words you use and the way you tell the story. Don't use offensive stories, including those involving inappropriate language or that involve sex, religion, ethnicity or racism. No speaker can become a success by using an off- color presentation. There is a large supply of words that can be selected so there is no need to choose off- color material that you think might get a laugh. Remember you are not a comedian or a clown - you are a public speaker. Such material is bound to offend some of your audience, but if you use appropriate language, it is unlikely to offend anyone.
3. Your story must be funny to you.
Don't tell the story as it is written or the way you have heard it - put it in your own words. Personalize it as though it is something that happened to you. Tell it the way you would tell it in a conversation with a friend. You can embellish it,dress it up. You can insert one-liners here and there making fun of yourself like something that happened to you during exercise or the size of your feet and people will be amused. Be careful not to make fun or put down someone in your audience or of someone, some place or company that listeners admire or you are likely to alienate your audience.
Timely Tips - You have heard "location, location, location" about real estate. With speaking, it is "rehearse, rehearse,rehearse". Tell your story to family and friends. Rehearse your speech in front of a mirror. You will probably get tired of the joke, but if you thought it was funny when you first heard it, chances are that your audience will enjoy it too. Don't laugh at your own story. If your listeners don't think the story is funny, your laughter won't change their minds. Don't introduce your story with "have you heard about..." or "here's a funny story...". A good story will sell itself and it should have an element of surprise. Don't eliminate the surprise. It's important to keep a straight face so you don't give away the punch line. Be confident and keep eye contact with your listeners straight through to the surprise punch line.
Some stories fail. Sometimes a speaker stumbles in telling the story or maybe the story chosen was not suited to the audience. If there are several speakers or a long program, the audience may be tired and inattentive or the sound system acts up and the story loses its tension. After you deliver the punch line, pause, and scan your audience. If you don't get a smile, a chuckle or a laugh, go on with your speech as though the story is meant to be serious. Your audience may accept it as serious and won't notice.
Don't give up. Keep a file of funny things that happen to you or those you see and hear. Draw on them as you prepare your speeches. Your speeches will be enhanced when you learn how to dress them up with humor.
